Terms of service
Berry and Bump Ltd — last updated 28 September 2026
These terms set out the agreement between you and us when you use berryandbump.com or buy anything from us. Please read them before you order. By placing an order you accept them.
We've written them to be readable. Where the law gives you rights, we say so rather than trying to write around them.
1. Who we are
Berry and Bump Ltd ("Berry & Bump", "we", "us", "our") is a company registered in England and Wales.
- Company number: 16846137
- Registered office: 124 City Road, London, England, EC1V 2NX
- Email: hello@berryandbump.com
"You" means the person using our site or placing an order.
These terms cover orders placed on berryandbump.com. If you buy our bars through Amazon, or from a shop that stocks us, your contract is with that seller and their terms apply, not these.
2. Who can order
You must be 18 or over and resident in the United Kingdom to buy from us. We currently deliver to addresses in the United Kingdom only. If you order from outside the UK we'll cancel the order and refund you.
You're buying as a consumer — for yourself, not for resale. If you want to stock Berry & Bump in a shop, café or subscription box, email hello@berryandbump.com rather than ordering here. Wholesale is governed by separate terms.
3. Our products, and what we don't claim
Berry & Bump bars are food. They are not a medicine, a supplement regulated as a medicine, a meal replacement, a medical device, or a treatment for any condition.
Nothing on our site, packaging, emails or social channels is medical or nutritional advice, and nothing we say is intended to diagnose, treat, cure or prevent any condition. If you are pregnant, breastfeeding, recovering from birth, taking medication, or managing any health condition, please speak to your GP, midwife, health visitor or a registered dietitian about your diet. Their advice comes first, not ours.
Any nutrition or health claims we make are limited to those authorised under assimilated Regulation (EC) No 1924/2006 on nutrition and health claims made on foods, as it applies in Great Britain.
Allergens
Our bars are vegan and gluten-free. Some contain peanuts and other nuts, and all are produced in a facility that handles nuts and other allergens, so we cannot guarantee any product is free from cross-contamination. Full ingredient and allergen information appears on every pack and on each product page. Please read it before eating.
How products appear
We photograph our bars honestly, but colours can look different on different screens, and a handmade-style bar varies slightly from one to the next. Small differences in appearance are not a fault. Recipes, packaging and specifications may change; the pack you receive is the authority on what's in it.
4. How an order is made
- You add items to your basket and go through checkout.
- Before you pay, you'll see the total price, any delivery charge, and the delivery estimate. Check your order at this point — this is your chance to correct mistakes.
- When you pay, you're making an offer to buy.
- We send an order acknowledgement email. This is not acceptance.
- A contract is formed only when we send you a dispatch confirmation email. If part of your order ships separately, a contract is formed for each item as it's dispatched.
We may decline an order — for example if the item is out of stock, we've spotted a pricing error, we can't deliver to your address, or we reasonably suspect fraud or resale. If we decline, we'll tell you and refund you in full. We don't have to give a reason.
5. Prices and payment
Prices are in pounds sterling and are shown on the product page. Delivery is charged separately unless your order qualifies for free delivery — see our Shipping & Delivery Policy.
Berry and Bump Ltd is not currently registered for VAT, so no VAT is charged on your order. If that changes, prices shown will include VAT and we'll say so here.
We can change our prices at any time, but a change won't affect an order we've already accepted.
Pricing errors. If a product is listed at an obviously wrong price and the error is one you could reasonably have spotted, we don't have to supply it at that price. We'll contact you to ask whether you'd like to proceed at the correct price or cancel, and we'll refund you in full if you cancel.
Payment is taken at checkout through our payment provider. We don't store your full card details. Payments are processed by Shopify Payments and any other provider shown at checkout, subject to their own terms.
Discount codes can't be combined unless we say so, have no cash value, may be withdrawn at any time, and are void if obtained or used in bad faith.
6. Delivery
We deliver to UK addresses only. Delivery terms, costs and timescales are in our Shipping & Delivery Policy, which forms part of these terms.
Unless we've agreed otherwise, we'll deliver within 30 days of the dispatch confirmation. If we miss that, you can give us a further reasonable period and, if we miss that too, cancel and get a full refund.
Risk. Under section 29 of the Consumer Rights Act 2015, your order stays at our risk until it comes into your physical possession, or into the possession of someone you've identified to receive it on your behalf. If it's lost or damaged before then, that's ours to put right, not yours. Ownership passes to you when we've received payment in full.
If you give the courier a standing instruction to leave parcels in a safe place, please bear in mind that couriers will generally treat a parcel left there as delivered. Tell us if it goes missing anyway and we'll take it up with them.
7. Returns, refunds and cancellation
Your rights to cancel, return and get a refund are set out in full in our Returns & Refunds Policy, which forms part of these terms. In summary:
- Faulty, damaged, wrong or undelivered orders: full refund or replacement.
- Unopened, sealed packs: 14-day right to cancel under the Consumer Contracts Regulations 2013.
- Opened or unsealed packs: we can't accept change-of-mind returns, on hygiene grounds.
Nothing in these terms affects your rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
8. Subscriptions
If you subscribe, you're agreeing to recurring deliveries at the frequency you chose (every 2, 4 or 6 weeks) at the subscription price shown, until you cancel.
- Discount. The subscriber discount applies to each subscription order while your subscription is active. It stops applying if you cancel.
- Payment. We take payment automatically on each renewal date using your saved payment method. Keep your payment and address details up to date in your account.
- Reminders. We'll email you before each renewal so you have time to skip, change or cancel.
- Changing or cancelling. You can pause, skip, change the frequency, or cancel at any time in your account, with no minimum term and no fee. Changes apply to the next order we haven't yet processed. If you'd rather not use your account, email hello@berryandbump.com and we'll do it for you.
- Price changes. If we change the subscription price, we'll tell you at least 30 days before it takes effect and you can cancel before then.
- Failed payments. If a payment fails we'll try again and let you know. If it still fails we may pause or cancel the subscription. We won't dispatch an order we haven't been paid for.
- Each delivery is a separate contract, so your cancellation and refund rights apply to each one individually.
9. Your account
If you create an account, keep your password confidential and don't let anyone else use it. Tell us at hello@berryandbump.com if you think someone else has access. You're responsible for orders placed through your account unless it's clear they weren't placed by you or anyone you authorised.
You must give us accurate information. We may suspend or close an account that's being used fraudulently, for resale, or in breach of these terms.
10. Using our website
You may use our site for your own personal, non-commercial purposes. You must not:
- copy, scrape, republish or resell our content, product photography, recipes, brand assets or site code;
- use automated tools to harvest data from the site;
- interfere with the site's operation, security or availability, or attempt to gain unauthorised access;
- upload anything unlawful, defamatory, abusive, misleading, or infringing someone else's rights;
- use our site or our brand in a way that suggests a partnership or endorsement we haven't agreed to.
We can withdraw access if you break these rules.
We try to keep the site available but we don't promise it will be uninterrupted or error-free, and we may change, suspend or withdraw any part of it. We'll give notice where we reasonably can.
11. Reviews and anything you post
If you post a review, photo, comment or tag us in content, you keep ownership of it, but you give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with Berry & Bump — on our site, in marketing, and on our social channels — with credit where practical. You can ask us to stop using it by emailing hello@berryandbump.com and we'll remove it from anything we control going forward.
By posting, you confirm the content is yours to share, is your honest opinion, and doesn't infringe anyone's rights.
If we gave you the product free, sent you a gift, paid you, or gave you a discount or any other incentive in connection with your review or post, you must say so clearly and prominently. Undisclosed incentivised reviews are a banned commercial practice under the Digital Markets, Competition and Consumers Act 2024, and we will remove any we find.
Please also don't post health claims about our products. We're legally responsible for claims made on our channels, so we may need to remove content that makes them, even when it's a genuine and generous review.
We may remove anything at our discretion. We don't endorse or verify what customers post.
12. Intellectual property
All content on berryandbump.com — the Berry & Bump name and logo, product names, packaging design, photography, copy, and site design — belongs to us or our licensors and is protected by copyright, trade mark and other rights. You get no rights in it beyond what these terms allow.
13. Our liability to you
We don't limit or exclude our liability where the law doesn't let us. That means we are fully liable for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- defective products under the Consumer Protection Act 1987;
- breach of your rights under the Consumer Rights Act 2015, including that goods are of satisfactory quality, fit for purpose and as described.
Beyond that: if we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach. Loss is foreseeable if it's obvious it will happen, or if we both knew it might when you placed your order. We're not responsible for unforeseeable loss.
We don't supply our products for business use. If you use them for any commercial or resale purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
14. Events outside our control
We're not liable for failing or delaying to perform these terms because of something outside our reasonable control — including supply failures, courier disruption, extreme weather, fire, flood, industrial action, epidemic, or the acts of government. We'll tell you as soon as we can and extend delivery times accordingly. If the delay is substantial, either of us can cancel and we'll refund you for anything you've paid for and not received.
15. Changes to these terms
We may update these terms. The version that applies to your order is the one on the site when you placed it, so it's worth saving or printing a copy. If we make a significant change affecting an active subscription, we'll email you at least 30 days beforehand and you can cancel.
16. Complaints
Email hello@berryandbump.com with "Complaint" in the subject. We'll acknowledge within 2 working days and aim to reply fully within 14 days.
We are not currently a member of any alternative dispute resolution scheme. If we can't resolve your complaint between us, you can get free independent advice from Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk, and you keep your right to take the matter to court.
17. General
Transfer. We may transfer our rights and obligations under these terms to another business; we'll tell you if we do, and it won't affect your rights. You may only transfer yours with our written agreement.
Third parties. Nobody other than you and us has rights under these terms. The Contracts (Rights of Third Parties) Act 1999 doesn't apply.
Severability. If a court finds any part of these terms unlawful or unenforceable, the rest keeps working.
Delay isn't waiver. If we don't insist on something straight away, or delay taking action, that doesn't stop us doing so later.
Privacy. How we handle your personal data is explained in our Privacy Policy.
Governing law. These terms are governed by the law of England and Wales. You and we both submit to the courts of England and Wales — but if you live in Scotland or Northern Ireland, you can also bring proceedings in your own country's courts.
